A foreign investor may set up the economic organisation to carry out the project before applying for the IRC (Article 19), but must meet market-access conditions when setting it up
Projects of foreign investors, and of economic organisations in which foreign investors hold over 50% of charter capital, must obtain an IRC (Article 26)
Domestic investors’ projects, and investment by capital contribution or share purchase in an economic organisation, do not require an IRC; capital contribution or share purchase registration may still apply
A company that already has foreign capital and a new project handles the new project without necessarily forming a new company (Article 20)

Organisation investor: business registration certificate or equivalent, financial statements; notarised, consular-legalised and translated into Vietnamese
Evidence of financial capacity
Lease agreement or arrangement for the site
